Aaron's JVC Capture your Dreams Video Contest

1. SPONSORS: Aaron Rents. Inc. ("Aaron’s") and JVC Company of America, a division of JVC Americas Corp. (“JVC”) collectively referred to herein as, the "Sponsors"

2. ELIGIBILITY: The Aaron’s/JVC “Capture Your Dreams” Video Contest (the "Contest") is open only to legal residents of the fifty (50) United States and the District of Columbia who are at least eighteen (18) years old at the time of entry and who have Internet access during the Entry Period (as defined below). Employees, members of their immediate family, or any household member, of the Sponsors, their respective company parents, affiliates, subsidiaries, advertising and promotion agencies, and any other person or entity involved in the design, execution or judging of the Contest are not eligible to enter or win. All applicable federal, state and local laws and regulations apply. Void where prohibited or restricted by law.

3. CONTEST PERIOD: Between 12:01 a.m. ET on November 1, 2007, and 11:59 p.m. ET on May 31, 2008 (the "Entry Period"), visit www.shopaarons.com (alternatively referred to herein as the "Site") and follow the link to the Contest site and subsequent directions to first register and then correctly upload your video entry. Submissions (as defined below) not meeting the subject matter criteria shall not be considered. Sponsors may choose to accept or reject your Submission based on their sole judgment. Prize Winners will be notified via email, telephone or U.S. Mail. VMIX Media Inc. (“VMIX”) is the administrator of the contest and VMIX.com’s computer is the official clock for the Contest. All Submissions become the property of Sponsors and shall not be acknowledged or returned.

4. CONTEST SUBMISSION: (a) Contest Details : During the Entry Period, “Capture Your Dream” by creating your own home video," and submit it to the Contest (the "Submission"). Visit www.shopaarons.com to view submission guidelines and to enter your Submission into the Contest.

(b) Submission Requirements:

The following file types are accepted for video entries: . wmv; .mov; .avi; .mpg; .mpeg; .mp4; asf; and .3gp
Must not exceed 500MB in size.
Must not exceed two (2) minutes in length
Must comply with all Content Restrictions (as defined below).

(c) Upload Phase: Go to www.shopaarons.com and follow the links and instructions for submission. All individuals who desire to participate in the Contest must first create a member profile on VMIX.com in order to upload submissions and thereby be an eligible participant ("Participant"). Participants who already have a member profile on VMIX.com do not need to register again. During the registration process, each Participant shall be required to click where indicated to confirm that such Participant agrees to be bound by these Official Rules and Regulations (“Official Rules”) and the Submission Guidelines. Any Submission that includes content which is deemed inappropriate, indecent, obscene or otherwise does not comply with the Content Restrictions listed in Section 5 below, as determined by Sponsors in their sole discretion, shall not be eligible. Sponsors shall have the right to copy, edit, modify, adapt, distribute, display, perform and publish any or all of the Submissions, and may use them in any media without attribution or compensation to the Participant, his or her successors or assigns, or any other entity. ENTERING A SUBMISSION IN THIS CONTEST CONSTITUTES PARTICIPANT’S IRREVOCABLE ASSIGNMENT, CONVEYANCE, AND TRANSFERENCE TO THE SPONSORS OF ALL RIGHT, TITLE, AND INTEREST IN THE SUBMISSION, INCLUDING, WITHOUT LIMITATION, ALL COPYRIGHTS. The Sponsors are not responsible for lost, late, incomplete, invalid, unintelligible, or misdirected Submissions, which are void. In addition, by entering, Participants represent and warrant that the Submissions that they submit are their own original creations, do not infringe any other person’s or entity’s rights, have not been submitted previously in a contest of any kind, and that they have obtained permission from all people featured or appearing in the Submission to enter this Contest.

(d) Limit: Each Participant may enter ONLY one (1) submission per month during the Entry Period. Multiple Participants are not permitted to share the same email address. Any attempt by any Participant to enter more than one (1) Submission per month by using multiple/different email addresses, identities, registrations, or any other methods shall void all Submissions entered by that Participant and that Participant, at the sole discretion of the Sponsors, may be disqualified. Use of any automated system to participate is prohibited and shall result in disqualification. In the event of a dispute as to any registration, the authorized account holder of the email address used to register shall be deemed to be the registrant or Participant. The "authorized account holder" is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. A Participant may be required to show proof of being the authorized account holder.

5. CONTENT RESTRICTIONS: Your Submission must NOT contain:

Nudity;
Material that violates or infringes another’s rights, including but not limited to privacy, publicity or intellectual property rights;
Images and/or artwork that that are copyrighted, trademarked, protected by trade secret or otherwise subject to third party proprietary rights, including privacy and publicity rights, unless you are the owner of such rights or have permission from their rightful owner to post the material;
Gratuitous violence;
Dangerous stunts;
Real weapons of any kind, including but not limited to guns, knives or projectiles;
Drug use;
Smoking;
Material that is hateful, tortuous, defamatory, slanderous or libelous;
Material that promotes bigotry, racism, hatred or harm against any group or individual or promotes discrimination based on race, sex, religion, nationality, disability, sexual orientation, age or any other basis protected by Federal, State, or Local Law, Ordinance, or Regulation; and
Material that is unlawful, in violation of or contrary to the laws or regulations in any state where the Submission is created.

Failure of any Submission to comply with the above restrictions (collectively, the "Content Restrictions"), as determined by the Sponsors in their sole discretion, shall result in disqualification. Sponsors may, at their sole discretion, disqualify a Participant from participating in any aspect of the Contest, if the Sponsors deem or suspect that such Participant has engaged directly or indirectly in, or has attempted to engage in any of the following: (a) acting in violation of the Official Rules, or any terms and conditions relating to use of or access to the Site; or (b) submitting a Submission that the Participant has not personally authored (submitting someone else’s work); or (c) damaging, tampering with or corrupting the operation of the Contest; or (d) acting with intent to annoy, harass or abuse any other person; or (e) any unsportsmanlike, inappropriate, uncooperative, disruptive, fraudulent, potentially fraudulent, or unusual behavior or activity; or (g) activity deemed in the sole discretion of the Sponsors and their agents to be generally inconsistent with the intended operation of the Contest. Any person attempting to deliberately damage or corrupt the Contest website or undermine the operation of the Contest will be subject to immediate disqualification and may also have violated criminal and civil laws. Should such an attempt be discovered, the Sponsors and/or VMIX.com and their agents reserve the right to prosecute and seek damages from any such individual to the fullest extent of the law.

6. JUDGING/REQUIREMENTS OF CONTEST WINNERS: Following the Entry Period, qualified judges chosen by the Sponsors (the"Judges"), shall choose the Potential Winners from all eligible submissions based on the following criteria: 40% entertainment of the Submission; 30% originality of the Submission and 30% creativity of the Submission. When registering their submission all Participants must provide a mailing address which includes a street address (no P.O. boxes). Notification of Grand, First and Second Prize Winners will occur within 14 days following the Entry Period. Any attempt to contact a potential prize winner via either U.S. Mail and/or telephone which is unsuccessful due to the prize notification being either returned as undeliverable or the provided telephone number being incorrect or no longer in service, may result in disqualification and an alternate winner will be selected solely at the Sponsors discretion. The decisions of the judges in all and any matters related to the Contest shall be final and binding. The Grand, First and Second Prize Winners will be required to complete and return certain Affidavits of Eligibility, Tax Releases, and Name and Liability Releases, as well as complete and return a 1099 form based on the average retail value (“ARV”) of the prize they have been awarded. Failure to return these documents in a timely manner, as determined by the Sponsors may result in disqualification and an alternate prize winner will be selected. Winners are solely responsible for the reporting and payment of all federal, state and local taxes (if any). Sponsors reserve the right to substitute any prize(s) of like value in the event that the described prize(s) is unavailable for any reason whatsoever. By entering the Contest all Participants agree to be bound by these Official Rules. Acceptance of any prize shall constitute and signify the Winner’s agreement and consent that the Sponsors and VMIX.com shall have the right to use the Winner’s name, address (only city and state), likeness, and/or prize information for contextual purposes worldwide, including the internet, without limitation and without further payment or consideration, expect where prohibited by law.

7. PRIZES: Grand Prize-ONE (1). The Grand Prize Winner will receive a JVC 70” High Definition Television (ARV $2,199), First Prize-One (1). The First Prize Winner will receive a 42” JVC LCD Television (ARV $1200), Third Prize-One (1). The Third Prize Winner will receive a JVC Home Theater System TH-S11 (ARV $399). In addition the first fifty (50) entrants each month will win a commemorative t-shirt (ARV $4 each). Total value of prizes $4998.

8. GENERAL RULES: By entering or participating in the Contest, Participants agree to be bound by these Official Rules. Neither Aaron’s, JVC or VMIX.com assume any responsibility for electronic hardware, programming or software malfunctions, or failures, or line connections, accessibility or availability, or technical failures of any kind, or unauthorized human intervention, or the incorrect or inaccurate capture of any Submission or other information, or for the failure to capture any such information. The Sponsors and VMIX.com are not responsible for: (1) any incorrect or inaccurate information, whether caused by Participants, or by any of the equipment or programming associated with or utilized in the Contest; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the Submission process or the Contest; or (4) technical or human error which may occur during the administration of the Contest or the processing of the Submissions. Further, if for any reason the Contest is not capable of running as planned by reason of infection by virus, bugs, worms, tampering, unauthorized intervention, fraud, technical failures, or any other causes which, in the sole opinion of the Sponsors, may corrupt or effect the administration, security, fairness, integrity or proper conduct of this Contest, the Sponsors reserve the right, at their sole discretion, to cancel, delay, terminate, modify or suspend the Contest, and select the Winners from the Submissions received prior to the action taken or in other such manner as deemed fair and appropriate by the Sponsors. In the event of cancellation, delay termination, modification or suspension of the Contest, the Sponsors shall post a notice to such effect on the Site.

Each Participant, by participating in this Contest, hereby waives and releases, and agrees to hold harmless, Aaron’s, JVC, VMIX.com and all contest and advertising agencies, and their respective parents, subsidiaries, affiliates, and distributors, and all of their respective officers, directors, shareholders, employees, representatives and agents (collectively, "Indemnified Parties"), from and against, any and all rights, claims and causes of action whatsoever that such Participant may have, or which may arise, against any Indemnified Parties for any liability for any matter, cause or thing whatsoever, including but not limited to any injury, loss, damage, whether direct, compensatory, incidental or consequential, to person, including death and property, arising in whole or in part, directly or indirectly, from such Participant's acceptance, possession, use or misuse of the prize in the Contest, or such Participant's participation in the Contest, or his or her participation in any Contest or prize related activity, or any travel related to the Contest or any travel for any prize related activity. Each Winner also further acknowledges that the Indemnified Parties, have neither made, nor are in any manner responsible or liable for, any warranty, representation or guarantee, expressed or implied, in fact or in law relative to any prize or this Contest including but not limited to quality, condition or fitness for a particular purpose. Except where prohibited, each Participant agrees that any and all disputes, claims and causes of action arising out of or connected with this Contest or any prize awarded shall be resolved under the laws of the State of Georgia, without respect to any conflict of law issues, and each Participant agrees that such shall be resolved individually, without resort to any form of class action, and exclusively by the Federal and State Courts of Fulton County, Georgia.

The Sponsors and/or VMIX.com are not responsible for any typographical or other errors in the offering or announcement of prizes, in the Official Rules, or in the administration of the Contest, or any inaccurate or incorrect data contained on the Site, or any personal injury or property damage or losses of any kind which may be sustained to any Participant's or any other person's computer equipment resulting from participation in the Contest, or use of or download of any information from the Site. Use of the Site is at each Participant's own risk. WITHOUT LIMITING THE FOREGOING, the Site AND ALL MATERIALS PROVIDED THROUGH OR IN CONNECTION WITH THE SITE ARE PROVIDED "AS IS" WITHOUT ANY WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. SOME JURISDICTIONS MAY NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES OR EXCLUSION OF IMPLIED WARRANTIES; CHECK YOUR LOCAL LAWS FOR ANY RESTRICTIONS REGARDING THESE LIMITATIONS OR RESTRICTIONS. The Sponsors and/or VMIX.com do not make any, and hereby disclaim any and all, representations or warranties of any kind regarding any prize. All Winners, on behalf of themselves, their executors, employers or companies, heirs and assigns, by acceptance of a prize, agree to release the Sponsors and VMIX.com, and their affiliates, officers, employees and subcontractors from any and all liability, claims or actions of any kind whatsoever for injuries, damages or losses of any kind to persons or property which may be sustained in connection with the receipt or use of any prize, or while preparing for or participating in the Contest, or any activity in connection with the Contest or otherwise. The Sponsors reserve the right to amend these Rules at any time, including without limitation, as necessary to comply with any applicable law or regulation. The Sponsors may, in their sole discretion, take whatever measures the Sponsors deem necessary or appropriate to preserve the integrity of the Contest.
